Yet another question, is there a way to force ftp transfer to be binary ?

On the "Transfer" tab of the FTP profile you can switch the "Transfer type" between Auto, ASCII, and Binary.

ahh there is no way of doing it when in "folder compare" then ?
- ie folder <-> ftp-site
and i want to force transfer maybe 3 files with binary ?

Yes, but it is a configuration in the FTP Profile as Craig mentioned. In the Tools menu -> Profiles, select the FTP Profile, and in the Transfer tab you can set the transfer type (Auto, ASCII, or Binary). Then launch the Folder Compare, connect, and perform the transfer.
