Assuming "New version available" refers to a newer version, then is it appearing when it should not:

There is a newer version: 3.3.5. I am not sure why the webpage display is not updated for you. Perhaps it is a caching problem. Please reboot, then use the Help menu -> Check for Updates.

That display is not in a web browser. It is in Beyond Compare.

I rebooted the OS - problem persists.

That dialog is a web page that our server returns in response to the check for updates request. The dialog itself just embeds an Internet Explorer window.

In cases like this the issue is usually too aggressive caching by the ISP. We've had occasional customer comments that our setup points to the wrong file, which is fixed by pointing them towards the same file with the version number included.

Ah. Please pass on my suggestion that BC use a more reliable method - perhaps the one that successfully drives the alert. Thanks.

PS Thanks for this useful and discreet alert.
